12. Waiver

13. Dispute Resolution

If a dispute arises during your use of this Website or under these Terms, You agree to abide by B. F. Pennysaver dispute resolution principles by proceeding in this order of dispute resolution, only proceeding to the next step if the previous step has not resolved the issue satisfactorily.

  1. Send an email to B. F. Pennysaver at: Customer.Service@bfpennysaver.com describing the nature of the issue.

  2. Send B. F. Pennysaver a letter by registered mail, outlining in detail the problem, steps taken and matters remaining to be resolved to: 7 River Street, Andover, MA 01810

  3. If, after two weeks, the matter has not been resolved, You agree to submit to binding arbitration, to be conducted by a member of the American Arbitration Association, in Boston, at Your expense. If You win, B. F. Pennysaver will pay the arbitration expenses and Your reasonable attorney's fees. If B. F. Pennysaver wins, You agree to do the same for B. F. Pennysaver.

By accepting these terms, You waive Your right to go to court, to have a jury trial or to participate in a class action lawsuit. You also agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms must brought under this dispute resolution policy within one (1) year after such claim or cause of action arose or be forever barred.
